basic background scenario
In parentheses, after the case citation, you will find some aspect of contract law being covered in Week 4 or Week 5; if the case has multiple issues, just concentrate on the one or more topics you see in parentheses after the citation. The basic question you will likely be answering in your post in this forum is whether there is an enforceable contract, under the facts of the case, but there are four items you must cover thoroughly (not just one sentence for each of the four items). Your Wks4-5Dsc post must include
a) a brief summary of the facts, so that others will understand the basic background scenario (they will not have read it, so you will need to summarize it);
b) a brief discussion of the particular aspect of contract law applicable to the facts of the case (in other words, be prepared to discuss generally (not with respect to the case itself) the legal concept(s) I’ve indicated in parentheses);
c) a brief discussion of how the court analyzed the applicable law; and
d) what conclusion the court reached, about whether there was a contract, and/or whether it was enforceable
(if the court reached any conclusion about enforceability).
This will be a practice for your individual presentation, which will be scheduled to occur during Weeks 6-8, volunteers first. Be sure to not leave this until the last moment, because it will take a little time to do, and is two weeks’ worth of available points. Here are your choices ( there is one for everyone):
16) Donald B. Murphy Contractors v. King County, 112 Wn.App. 192 (2002) (Third-party beneficiaries) (James)
You don’t have to copy the question, just give the number of the question. For example, a) b) c) d)
